LIFETIME LABOR Warranty

This is a labor warranty provided by Express Home Services, LLC dba Express Flooring to you, the original purchaser (“Owner”). This warranty covers labor only. It does not take the place of or affect the manufacturer’s warranty on the material used. Please consult your third-party manufacturer warranties for further coverage. 

 Warranty: Express Flooring warrants to the Owner that the installation work performed by Express Flooring will be free of defects due to workmanship for as long as Owner owns and resides in the home where Express Flooring performed the installation, subject to the other terms and conditions contained in this warranty.

 What Is Not Covered: Express Flooring grants this warranty to the Owner only and only materials purchased from and installed by Express Flooring are covered by this warranty. This warranty assumes normal and reasonable use of products or components. This warranty does not cover any other damage or material failure including, but not limited to, damage caused by existing defects at Owner’s property or existing underlayment not installed by Express Flooring, damage caused by occurrences beyond the control of Express Flooring, such as acts of God, settlement of the building, failure of the structure (including foundations and walls), use of incompatible accessories, removal, repair, or re-installation of any products or components by other than Express Flooring, normal corrosive effects of chemicals, intentional acts, or unreasonable use or failure to provide reasonable maintenance as and when necessary. For vinyl, wood, tile, stone, and laminate installations, this warranty does not cover discoloration from asphalt driveways, indentations from high heels, scratches and damage caused by chairs, tables, appliances, wheelchairs or motorized scooters, pets, and other tangible objects. Installation, removal, repair, adjustment, tampering, or re-installation of any products or components by other than Express Flooring voids this warranty, and Express Flooring expressly disclaims any liability for any costs, defects, or damages with respect to such actions. Owner acknowledges that professionally installed carpet may require re-stretching after approximately 24 months, that such is a part of normal maintenance, and such is not covered by this warranty.

How to Obtain Warranty Service: To submit a claim, a copy of this warranty and a copy of the Owner’s sales contract must be submitted in writing by U.S. mail or nationally recognized overnight delivery service to Express Flooring at 4110 W. Washington Street, Suite 100, Phoenix, AZ 85009 with a brief explanation of the claim. Claims must be submitted promptly after discovery of the claimed defect. Within a reasonable period after having received the Owner’s claim, Express Flooring will schedule an appointment to inspect the premises and the warranty claim. Starting two years after the inception date of coverage under this warranty, Express Flooring will charge Owner and Owner agrees to pay a $50 warranty processing fee for each asserted claim. If after inspection of an alleged claim, Express Flooring determines that a valid claim exists, Express Flooring will repair, re-install, replace, or refund the purchase price of the failing service, at our option. If Express Flooring decides to replace any or all product(s), and if such product(s), as originally installed, is no longer available, Express Flooring shall have the right to substitute product(s) designated by Express Flooring to be of equal quality. If, at Express Flooring’s option, a purchase price refund is conveyed to the Owner, then this warranty is terminated, and the repair, replacement, or removal of the product shall become the sole responsibility of the Owner. This warranty is not valid unless and until the Owner has made full payment under the original sales contract and all addenda thereto. Non-warranty calls for repair or adjustment or calls under a third-party product and/or manufacturer warranty (i.e., claims not related to this labor warranty) may result in a service charge.

Remedies and Rights: This warranty is the only express warranty provided by Express Flooring. No employee, representative, agent, or any other person, has authority to assume or incur on behalf of Express Flooring any obligation, liability, or responsibility in place of or in addition to this warranty. EXPRESS FLOORING HEREBY EXCLUDES AND DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BY WAY OF ILLUSTRATION AND NOT LIMITATION, WARRANTIES OF FITNESS FOR PARTICULAR PURPOSE, HABITABILITY, AND MERCHANTABILITY. Express Flooring’s liability to the Owner under this warranty is limited to the amounts received by Express Flooring for services rendered under the sales contract with the Owner. In no event shall Express Flooring be obligated or liable for incidental, special, indirect, or consequential damages of any kind for the breach of any express or implied warranty.
