1. SMS Messaging Program

By providing your mobile phone number and affirmatively opting in, you provide your prior express written consent to receive text messages and/or calls from Express Flooring or its affiliates at the number provided, including messages sent using an automatic telephone dialing system, automated technology, or an artificial or prerecorded voice, where applicable.

Consent to receive marketing communications is not a condition of purchase.

Your consent applies to the phone number provided and remains effective unless and until revoked.

4. Message and Data Rates

Message and data rates may apply according to your mobile carrier’s plan. Express Flooring is not responsible for delays in delivery or carrier-imposed charges.

Wireless carriers are not liable for delayed or undelivered messages.

5. Help, Opt-Out and Revocation of Consent

• Replying STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or OPT OUT to any message; or

Upon receipt of a valid opt-out request, we will process your request within a reasonable time and you will no longer receive SMS messages, unless you subsequently provide new consent.

Opting out of marketing messages does not affect service-related or transactional communications that are permitted by law.

6. Eligibility and Accurate Information

By opting in, you represent that:

• You are the subscriber or customary user of the phone number provided;
• You are authorized to provide consent for that number; and
• The information you provide is accurate and current.

You agree to notify us promptly if your mobile number changes.

9. Limitation of Liability

To the fullest extent permitted by law, Express Flooring shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of participation in the SMS program.

10. Governing Law

These Terms shall be governed by the laws of the state in which Express Flooring is headquartered, without regard to conflict-of-law principles.
